1. Preliminary provisions
The General Conditions of Use define the contractual conditions of the relationship between Bellerose and the site second-hand.bellerose.be, and the online users wishing to use the services offered on the Site.
The "Site" means the platform under the domain name second-hand.bellerose.be, on which the services of Bellerose are offered, namely the sale and purchase of second-hand items under the brand Bellerose Second Hand.
The services of the Site are reserved to persons residing in Belgium.
The Site is limited to natural persons and for the personal use of the Articles purchased or sold. The Site may not be used to support any commercial activity, in any form whatsoever.
Except in cases of force majeure, Bellerose undertakes to implement all means to provide users on the Site access to the pages of the Site and access to the account of each member.
1.1 Registration and Member Account
1.2 Members' obligations
A Member must guarantee the truthfulness and accuracy of the information he/she provides on the Site, and in particular of his/her civil status data. At any time, Bellerose may ask the Member to prove the accuracy of his civil status data by sending a copy of his identity card and a proof of address (EDF bill). The failure to send the proofs within one month from the request authorises Bellerose to delete the Member Account. The Members must execute the contracts concluded in the framework of the use of the Site in perfect good faith.
A Member must not :
Offer counterfeit items. (Create more than one account under any circumstances).
Manipulate or intentionally disrupt the Site and the billing process.
Disseminate false information, defamatory information, slanderous information, and/or information including personal information.
Transfer your account and login information to another user.
Copy, modify or distribute Site content, Site services and tools and the Site brand.
Harvest or collect information about Members without their consent or the consent of Site.
Harvest or collect information about the Site without the consent of the Site.
Hack, modify, deface or destroy Site data and access Site data that is not accessible or explicitly presented
Post or disseminate in any form whatsoever information or content that has the effect of diminishing, disorganising, preventing the normal use of the services, interrupting and/or slowing down the normal flow of communications between Members via the services, such as software, viruses, logic bombs, mass mailings, etc.
Disseminate viruses or any other technology that could harm the Site, the interests of Site Members or their property.
Failure to comply with these prohibitions may result in the deletion of the Member's Account, after an unsuccessful attempt to cease the breach of contract has been made by email within 7 calendar days of the email being sent by Bellerose. Bellerose also reserves the right to close Member Accounts that have not been confirmed, as well as accounts that have been inactive for more than one year.
1.3 Continue as a Customer
If you only wish to use the Site to purchase an item, you do not necessarily need to create a Member Account and you can make the purchase as a "Customer".
2. Sell - Take Back Service
The Site offers a "Take-Back" service, open to any registered Member. When a Member sends items directly to the Site in exchange for a credit, it is called a Trade-in. The "Credit" means the amount indicated on the Site for the trade-in of an Item at the time of entry on the Site under the heading Trade-in.
The rules for packaging are as follows;
Dimensions of the parcel: it is the responsibility of the Member not to exceed the maximum dimensions (the sum of the length, width and height must be less than 120 cm), indicated on the Site
Weight of the parcel: it must correspond to the weight of the advertised Article and must not exceed 20 kg.
The packaging of the parcel must secure the contents and allow for handling and transport without risk to its integrity, but also for the safety of the transport personnel.
In the event that a Member does not respect these packaging rules, the carrier may refuse the package, at its sole discretion. In this case, the Member's package may also be blocked in the carrier's office and its recovery will be at the Member's expense. The acceptance of a parcel by the carrier does not imply the acceptance of the conformity of the packaging to the rules indicated above. If these rules are not respected, a Member shall pay the additional cost and collect the package at his own expense. It is the sole and entire responsibility of the Member to enter correctly and in a complete, real and accurate manner the information that will allow the carrier to proceed with the shipment of the Article from the sending relay point to the deposit.
The Member deposits his parcel in one of the carrier's shipping points. In case of a lost or damaged parcel during the transport operation, the Mondial Relay insurance policy taken out by Faume will take care of the Member's compensation.
The Member who has confirmed a Take-Back commits himself/herself to come and deposit his/her Article within 15 days following the reception of the confirmation e-mail. If this is not the case, the transport note will be invalid and the exchange will be cancelled. Nothing prevents the Member from creating a new Trade-in.
Step 3: The Site receives the Articles and checks each of the Articles within 10 working days following the reception of the parcel.
The Member receives a summary of the accepted or refused Items with their trade-in values by e-mail to the address he/she indicated on the Site during his/her registration.
In the event that the actual condition of the Article does not correspond to the condition indicated by the Member, the amount of the Credit shall be reduced proportionally or, if the Article is in an unacceptable condition, no Credit shall be granted, as described in Article 2.1. The Site will then take care of the enhancement and online display of the Articles.
Credit and voucher
The Member receives the amount of his credit on the Site, within his Member Account, in his electronic wallet. The amount is credited after the processing of the Items. The Member can convert the amount credited in the e-wallet into a "Purchase Voucher" to buy items on bellerose.com or convert it into a Purchase Voucher to buy items on Second-hand.bellerose.be and/or in one of the Bellerose shops in Belgium.
The voucher will contain a promotional code that the Member can enter at the end of his order for the discount to be applied. The voucher is valid for a period of one year, on any order of articles to pay the price of the articles and the associated delivery costs.
If the value of the order is higher than the amount of the voucher, the difference must be paid by the Member by one of the other payment methods proposed on the site or in the shop.
A promotional code cannot be used for an order already validated. All vouchers have an expiry date specified on them. All vouchers cannot be exchanged or refunded.
The Customer can add items offered for sale on the Site to their virtual basket. They can then access the summary of their virtual basket to confirm the Items they wish to order and place an "Order" by pressing the "Order" button. The customer will have to fill in an address, a delivery method as well as a valid payment method in order to finalize the Order and to effectively form the sales contract between him and Bellerose.
The finalization of the Order implies the acceptance of the prices of the articles sold, as well as the terms and conditions and delivery times indicated on the Site.
Once the Order is placed, the Customer will receive confirmation by e-mail. This confirmation will summarise the Order and the relevant delivery information.
The placing of an Order constitutes the conclusion of a distance selling contract between Bellerose and the Customer.
3.2 Items and prices
When a customer wants to buy an item sold by Bellerose through the site, the price indicated on the page of the item is the price in euros, all taxes included (TTC), excluding shipping costs and taking into account the discounts applicable and in force on the day of the order. The price indicated does not include delivery costs, which shall be detailed, where applicable, in the summary before the Order is placed. Under no circumstances shall a Customer be entitled to demand the application of discounts that are no longer in force on the date of the Order.
3.3 Terms of payment
Unless otherwise stipulated, all sales shall be paid for in cash at the time the Order is placed. Payment may be made by : Credit card via a secure Paypal connection Apple Pay
The Order will be delivered to the address provided by the Customer during the ordering process, and in accordance with the carrier's procedures. The delivery times indicated on the website and included in the shipping information are to be considered as a commitment of means and are not opposable to Bellerose. The items ordered by the customer can only be delivered to addresses within the designated territory, including Belgium. The risks of loss and/or damage become the responsibility of the Client as of the receipt of the order at the delivery address provided by the Client.
3.5 Right of withdrawal
The customer has a period of fourteen (14) days following the receipt of the Articles to exercise the right of withdrawal without justification. The customer shall inform Bellerose of his decision to withdraw by sending a clear and explicit statement by e-mail to "Customer Service" at the e-mail address email@example.com.
The Customer shall return the unused Articles, with their original labels, at its own expense.
The Customer will pay for the return, and will assume responsibility for the Items (including any risk of loss or damage) until they are delivered to the workshop based in Neuvy Saint Sépulchre.
If the above conditions are met and Bellerose has received the Items, Bellerose will refund the full amount of the order to the Customer, including the purchase price and shipping costs (excluding any additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery offered by Bellerose. The total purchase price will be refunded within 14 calendar days after Bellerose has received the Articles in due time, and provided that all the above conditions have been strictly respected. In no case shall the amount refunded exceed the amount actually paid by the Customer.
For the purpose of this refund, Bellerose will use the same payment method that the Customer used for the original transaction, unless otherwise agreed, and in no case will the Customer be charged for this refund, which does not include any coupons or discounts that the Customer received for this order. The Customer shall be refunded in accordance with the procedures agreed by the card-issuing bank. If a Member, as a Customer, has used a Voucher for their Order, the Member's Account will be credited again.
The Customer shall be liable for any loss of value of the Items if such loss is due to incorrect use of the Items for the purpose of establishing their nature, characteristics and function. Returns will only be accepted by the above method, and returns to the physical shop will not be accepted. It is not possible to exchange items. If the Customer wants another Item instead of the original order, he/she can invoke the right of return as described above and then place a new order for the desired Item.
3.6 Legal guarantee

7. Applicable law and jurisdiction
You acknowledge that you are aware of the following information and details : the essential characteristics of the Article; the price of the Articles; the date or the period in which Bellerose undertakes to provide the Service; information relating to the identity of Bellerose (postal, telephone and electronic contact details); information relating to the legal and contractual guarantees and their implementation procedures; the possibility of resorting to conventional mediation in the event of a dispute; information relating to the right of withdrawal (period, procedures for exercising).
